Policy Statement

 

The University of South Florida maintains specific guidelines regarding all forms of harassment, which are consonant with the rules and policies of the University, as well as laws and rules of the State of Florida.  Sexual harassment, and all other forms of harassment, are inconsistent with the role of a professional and are not tolerated by the University. 

Within the College of Medicine, individuals with knowledge of harassment are encouraged to promptly report such activity to the Office of the Dean or the Associate Dean of Graduate Medical Education. 

 

The University of South Florida Guidelines on Sexual Harassment (Policy #0-008) are attached to this policy for reference.

Procedure

 

Responsible Party                                        Action

 

Resident/Medical Student Determines if any form of harassment, as defined in the attached USF guidelines, has occurred.

 

Immediately notifies the Dean of the College of Medicine or the Associate Dean for Graduate Medical Education or follows the procedure in the attached guidelines within 180 days of the incident.

 

Dean/COM or Associate Dean/GME Interviews Resident/Medical Student for details on the incident and follows appropriate chain of command of reporting and follow-up.

I.          Policy

 

Pursuant to Title VII of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, the Florida Educational Equity Act and in conformance with our policy of Equal Opportunity, it is the goal of the University of South Florida to create and maintain a work and study environment that is positive and free of discrimination. In order to help provide such an environment, faculty, staff and students must be aware that sexual harassment is sex discrimination.

 

II.             Definition

 

Sexual harassment is defined as conduct of a sexual nature or with sexual implications, which interferes with an employee's or student's status or performance by creating an intimidating, hostile, or offensive working or educational environment. This conduct may include, but is not limited to, the following:

                -                 inappropriate touching (this may also constitute the crime of   battery);

                -                 the display of sexually explicit or suggestive material;

            - use of sexually explicit or suggestive language or gestures; and subtle pressure for sexual activity, as well as demands for sexual favors or physical assault. Sexual harassment is a serious form of abuse.

 

III.             Prohibitions

 

A.         Sexual harassment is unacceptable conduct that will not be tolerated at the University.*

 

B.         Malicious, false accusations of sexual harassment will not be tolerated.*

 

C.         It is prohibited for any administrator, supervisor, or other employee of USF to take any retaliatory action against an individual who, in good faith, has made a charge, testified, assisted, or participated in any manner in an investigation, proceeding, or hearing under provisions of applicable law.*

 

*Disciplinary actions could range from oral reprimand to dismissal from the University.

IV.             Procedure

 

If you believe you are the victim of sexual harassment and wish to explore resolution within the University, you should take one or more of the following actions within 180 days of the incident:

a.             Talk to the person whose actions you find offensive.

b. Talk to the administrative head of the department in which you are employed or enrolled.

c. Consult the student advocate, ADM 151, 974-2151 or Victim's Advocate, ADM 273, 974-5757.

d.             Contact the Office of Equal Opportunity Affairs, ADM 274, 974-4373.

 

The Office of Equal Opportunity Affairs is committed to assisting you with the resolution of your complaint. However, should any resolution reached by the EOA Office be unsatisfactory, you may request that the Director of Equal Opportunity Affairs conduct a redetermination of the complaint decision.

 

If you prefer to file a complaint with an external agency, you may contact one of the following within the time limit set by the appropriate agency following the incident:

a.             U.S. Equal Employment Opportunity Commission,. 813/228-2310 (Tampa).
